Mighty Mule Gift Card Terms and Conditions
Mighty Mule Gift Card Terms and Conditions
Last updated: October 26, 2026
These Mighty Mule Gift Card Terms and Conditions (“Terms”) govern the purchase, delivery, and redemption of Mighty Mule gift cards (“Gift Cards”). By purchasing or using a Gift Card you agree to these Terms, our Terms of Service, Refund Policy, and Privacy Policy.
These Terms are written to satisfy the strictest gift card law applicable in any U.S. state, and we apply them to every Gift Card we sell anywhere in the United States, regardless of where you live. Where the specific state in which you reside grants you a greater right than these Terms describe, that state’s law controls and we will honor it.
1. What a Gift Card Is
- A Mighty Mule Gift Card is a prepaid, limited-value payment method redeemable only for merchandise we sell through mightymule.com. It is a store gift card — a closed-loop, single-merchant product. It is not a general-purpose prepaid card, credit card, debit card, bank product, or deposit account.
- A Gift Card is not issued by a bank, is not FDIC- or NCUA-insured, and does not earn interest. It represents an unsecured obligation of Mighty Mule.
- Gift Cards are issued and delivered electronically only. We do not sell or issue physical cards, plastic cards, or paper gift certificates. No Gift Card is redeemable at any merchant other than Mighty Mule.
2. Purchase
Denominations: $100, $200, $300, $400, $500, $600, $700, $800, $900, $1000. The purchase price equals face value.
- For a Gift Card, we charge no activation, issuance, handling, processing, delivery, or service fee of any kind, at any time, for any reason.
- No sales tax is charged on the purchase of a Gift Card. Tax is calculated on merchandise when the Gift Card is redeemed.
- Gift Cards may not be purchased with a discount code, promo code, coupon, loyalty redemption, store credit, or another Gift Card, unless we state otherwise in writing.
- We may limit purchase quantities and may refuse or cancel any Gift Card order, including where we suspect fraud, resale, or abuse.
- To purchase a Gift Card, you must be at least 18, or the age of majority in your jurisdiction.
3. Delivery
- Digital delivery only, by email to the recipient address you provide, after payment clears.
- Normal delivery: usually within 15 minutes. Up to 24 hours at peak.
- You are responsible for the accuracy of the recipient email address. We cannot recover a Gift Card delivered to an address you entered incorrectly, except as required by Section 8.
- Orders flagged by our processor or fraud review as medium or high risk may be held for review and cancelled if we cannot verify them.
- No shipping charges apply to a Gift Card-only order. If purchased alongside merchandise, the Gift Card is delivered electronically and the merchandise ships separately under our shipping policy.
4. Redemption
- Enter the code in the gift card field at checkout on mightymule.com. Gift cards apply as a payment method, not a discount.
- Redeemable for any Mighty Mule merchandise we offer on mightymule.com, subject to availability.
- Partial redemption permitted. Unused balance remains on the Gift Card.
- Multiple Gift Cards may be combined in one order.
- If the order exceeds the Gift Card balance, pay the difference with another method.
- Gift Cards cannot be used to purchase Gift Cards, and cannot be applied to a gift card, store credit, or account balance.
- Product exclusions, if any, will be stated on the product page and will not be applied retroactively to balances already held.
- Denominated in USD. Not convertible to other currencies.
5. NO EXPIRATION — EVER
- Gift Cards never expire. We impose no expiration date on the funds, the code, or the Gift Card itself. There is no date after which a balance becomes unusable.
- This exceeds what federal law requires (a five-year minimum) and satisfies the strictest state standard (an outright ban on expiration, as in California, Connecticut, Florida, Minnesota, Montana, Oregon, Rhode Island, and Washington, and Maine’s “no time limit”). It applies to every Gift Card we sell in every state.
- Because our Gift Cards do not expire, the federal replacement-notice requirements for expiring cards do not apply. We nonetheless commit that if we ever discontinue, replace, or migrate our gift card system, we will honor every outstanding balance or provide a free replacement code.
6. NO FEES — EVER
- We charge no fee of any kind on a Gift Card, at any point in its life. No activation fee, issuance fee, purchase fee, handling fee, dormancy fee, inactivity fee, service fee, maintenance fee, redemption fee, balance-inquiry fee, replacement fee, or expiration fee.
- This is stricter than both federal law (which permits a disclosed dormancy fee after 12 months) and every state (the strictest being Arizona’s “no fees of any kind” and those states that ban dormancy and service fees outright).
- We reserve the right to charge a replacement fee for a lost or stolen Gift Card in a future version of these Terms, because federal law permits it — but we do not charge one today.
7. Lost, Stolen, and Unauthorized Use
- Treat a Gift Card code like cash. Anyone with the code can spend the balance.
- If you can provide proof of purchase sufficient for us to verify the original order and invalidate the compromised code, we will make reasonable efforts to deactivate the original Gift Card and issue a replacement Gift Card for the unredeemed balance. We may require order confirmation details. A fully redeemed Gift Card cannot be reissued.
- Contact nicepartnersupport@niceforyou.com immediately if you believe unauthorized use has occurred.
- Scam warning: No legitimate business, government agency, or support representative will ever ask you to pay a debt, fine, tax, or fee with a gift card, or to read a code aloud or send a photo of it. If someone does, it is a scam. Report it at ReportFraud.ftc.gov.
8. Refunds, Returns, and Order Adjustments
- Gift Card purchases are final and non-refundable, except where required by law or where non-delivery resulted from our error.
- If you return merchandise paid with a Gift Card, the amount originally paid by Gift Card is refunded to a Gift Card, not to cash. The refunded balance carries these same Terms, including no expiration and no fees.
- Mixed payment: refund applies first to the Gift Card up to the amount charged to it, then to the other method.
- If we cancel an order paid by Gift Card, we reissue the amount to a new Gift Card.
- If we cancel a Gift Card purchase before delivery, we refund the purchase price to the original payment method.
- We may deactivate a Gift Card and decline a refund where we determine it was obtained fraudulently or through an unauthorized payment.
9. Small-Balance Cash Redemption
Federal law does not require cash redemption. Some jurisdictions do, at thresholds ranging from under $1 to under $15. We apply two standards:
- 9A. National standard — every customer, every state: On request, we will redeem any Gift Card balance for cash if the remaining balance is under $15.00. We will redeem a balance of $1.00 or less on request in all cases. This satisfies California’s under $15 threshold, the highest in the country, plus every state at $5, $2.50, and $1.
- 9B. Massachusetts standard — Massachusetts residents only: If you are a Massachusetts resident, we will additionally redeem any remaining balance for cash once 90% or more of the Gift Card’s face value has been redeemed — even if the remaining balance is $15.00 or more. Example: $100 card, $12 left → National: yes (under $15). $500 card, $50 left → National: no. MA resident after $450 redeemed: yes.
- Residency: Because 9B depends on your state of residence, we may ask you to confirm Massachusetts residency (for example, a Massachusetts billing or shipping address on a recent order) before paying a redemption under the Massachusetts standard. We will not request documentation beyond what is reasonably necessary, and a declined or unverifiable residency claim does not affect your right to the national standard in 9A.
- 9C. How to request: Contact nicepartnersupport@niceforyou.com or use the form at mightymule.com/pages/gift-card-cash-out. Provide the Gift Card code and your state of residence. We will verify the balance and pay the qualifying amount by check or electronic funds transfer — your choice, normally within 10 business days.
- You do not need to visit a store — we are online-only, and we do not require in-person presentation. We will not require you to make an additional purchase, present a physical card, or appear in person as a condition of any cash redemption. We never reduce a balance below these thresholds through fees, because we charge none.
10. Prohibited Uses
- No resale or commercial distribution without our written consent; no unlawful use, money laundering, or fraud; no altering, duplicating, or generating codes; no automated testing or brute-forcing of codes; no purchasing Gift Cards with Gift Cards. We may deactivate a Gift Card and cancel associated orders if we reasonably believe any of the above occurred, and may refer the matter to law enforcement.
11. Promotional, Complimentary, and Business Gift Cards
- Gift Cards we issue free of charge — promotional, giveaway, loyalty, influencer, employee, or service-recovery cards — are governed by the terms stated on the code or in the promotion, which control over these Terms to the extent of conflict. Promotional cards may carry different values, a different expiration date, and exclusions. They are not refundable and not redeemable for cash, except that we will still honor Section 9’s cash redemption where required by the law of your state of residence.
- Bulk or corporate purchases may require a separate written agreement: nicepartnersupport@niceforyou.com.
12. Balance Inquiries
- Check a balance at mightymule.com, or contact nicepartnersupport@niceforyou.com. We do not charge for balance inquiries.
13. Unclaimed Property (Escheatment)
- A Gift Card balance that goes unredeemed for an extended period may become reportable as unclaimed property under state law, after which we may be required to remit it to a state and it will no longer be redeemable with us.
- Because our Gift Cards never expire and carry no fees, a dormant balance remains fully redeemable with us indefinitely unless and until it is reported under applicable unclaimed property law. We use a conservative internal dormancy assumption of three years for monitoring purposes, which is the shortest dormancy period used by any state for gift certificates. The law of the relevant state, not this paragraph, determines the actual reporting obligation.
- If we are required to report your balance, you may claim it from the appropriate state unclaimed property office.
14. Cash Redemption — No Other Cash Rights
- Except as stated in Section 9, Gift Cards are not redeemable for cash and no cash or cash-equivalent refund will be given for a Gift Card balance.
15. Limitation of Liability
- To the maximum extent permitted by law, our total liability arising out of or relating to a Gift Card is limited to its remaining balance. We are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits. Nothing in this section limits any non-waivable right you have under applicable consumer protection law, and nothing limits liability that cannot be limited by law.
16. Changes to These Terms
- We may update these Terms prospectively by posting a revised version at mightymule.com/pages/gift-card-terms. We will not apply any change retroactively to a Gift Card already purchased where the change would materially reduce your rights — including expiration, fees, or redemption rules.
17. Governing Law and Disputes
- These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that the consumer protection law of your state of residence applies where it provides a non-waivable right. Disputes will be resolved in the state or federal courts located in San Diego County, California, unless applicable law requires otherwise. Nothing in this section waives any right you have under the gift card or consumer protection statute of your state of residence.
18. Severability and Entire Agreement
- If any provision is unenforceable, the remainder stays in effect. These Terms, with our Terms of Service, Refund Policy, and Privacy Policy, are the entire agreement regarding Gift Cards, and control over any conflicting policy as to Gift Cards.
